1. Acceptance of Terms
By downloading, accessing, or using the Kinetic.FM mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Subscriptions and Auto-Renewal
Kinetic.FM offers premium features, including offline playlist downloads, through an auto-renewing monthly subscription ("Supporter Tier").
- Payment: Payment will be charged to your app store account (such as the Apple App Store or Google Play) at confirmation of purchase.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period.
- Cancellation: You can manage your subscriptions and turn off auto-renewal by going to your device's Account Settings after purchase.
- Kinetic.FM does not process refunds directly. If you purchased your subscription through an app store (such as the Apple App Store or Google Play), all billing and refunds are handled by that app store and are subject to its refund policies.
3. Intellectual Property and Content Usage
All audio streams, mixes, branding, and interfaces within the App are the property of Kinetic.FM and are broadcast under appropriate licenses.
- Offline Downloads: Premium offline downloads are provided strictly for personal, non-commercial playback within the Kinetic.FM app.
- Restrictions: You may not extract, rip, redistribute, sell, or publicly broadcast the audio files obtained through this App.
4. App Usage and Conduct
You agree to use the App only for lawful purposes. You may not attempt to reverse-engineer the App, bypass the payment firewall, or artificially inflate track "likes" or download quotas through automated scripts or bots.
5. Disclaimer of Warranties
The App is provided on an "AS IS" and "AS AVAILABLE" basis. While we strive for 100% uptime, Kinetic.FM does not guarantee that audio streams will be uninterrupted or error-free, particularly in areas with weak cellular or internet service.
6. Limitation of Liability
To the fullest extent permitted by law, Kinetic.FM shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including data loss or device malfunction.
